Mr. Wertheim has the proven experience to serve the diverse needs of his clients in business litigation. Mr. Wertheim provides strategic, transactional and ongoing legal counsel for start-up and established companies in a full range of industries. Mr. Wertheim assists in commercial disputes, environmental litigation, cost recovery actions, regulatory compliance, shareholder and partner disputes, franchise litigation, arbitration matters and consumer fraud cases. Mr. Wertheim meets each client's needs in the often emotional and demanding arena of litigation.
Real Estate
Mr. Wertheim represents clients in every facet of the real estate industry including, builders, lenders, developers and brokers. Mr. Wertheim has counseled clients on disputes concerning construction issues, redevelopment, condemnation actions and foreclosures.
Leasing
Mr. Wertheim prepares reviews and negotiates leases for landlords and tenants including land leases, office leases, shopping center and retail leases, leases for industrial facilities and leases for mixed-use projects.
Franchise
Mr. Wertheim assists clients in analyzing franchise disclosure documents and advising clients on the respective obligations of the franchisor and franchisee. Mr. Wertheim has also negotiated franchise agreements on behalf of proposed and existing franchisees. Mr. Wertheim, former Chair of the Franchise Law Committee for the New Jersey State Bar Association, taught a franchise seminar at the Small Business Development Center at Brookdale Community College for 17 years.
Mr. Wertheim ensures that franchisors are in compliance with franchise laws, including the New Jersey Franchise Practices Act. Mr. Wertheim represents clients in complex litigation matters, including issues related to franchise termination and post-termination obligations and uniform enforcement of franchise contract requirements. Some of these matters include the seeking of equitable relief to enjoin the termination of a franchise.
Commercial Litigation
Mr. Wertheim zealously pursues the claims of and defends the rights and interests of his clients in commercial, contract and regulatory disputes and business related matters. Mr. Wertheim represents corporations, limited liability companies, closely held businesses, individuals and corporate disputes, insurance recovery actions, contract disputes, corporate law, estate/probate, construction, and real estate development matters. Mr. Wertheim has been involved in cases concerning a wide variety of commercial areas, including: environmental claims, restrictive covenants, specific performance and other equitable claims, insurance litigation, breach of contract and business tort actions, real estate related litigation, will contests, construction claims, consumer claims and corporate shareholder suits.
Employment
Mr. Wertheim has experience in mediating, arbitrating and litigating matters involving former employees who are alleged to have violated restrictive covenants, misused confidential information and trade secrets, as well as matters involving employee dishonesty and disloyalty, and contract disputes. Mr. Wertheim helps clients create strategies to support their concerns, objectives, and goals.
